Elkins Man Sentenced to 215 Months for Fentanyl Distribution
ELKINS, WEST VIRGINIA — Joshua Lee Rutherford, 32, of Linn, West Virginia, was sentenced to 215 months of incarceration for his role in a methamphetamine and fentanyl distribution operation, Acting U.S. Attorney Randolph J. Bernard announced.
Rutherford pled guilty in January 2021 to one count of “Possession with Intent to Distribute at Least Forty Grams of Fentanyl—Aiding and Abetting.” Rutherford admitted to having more than 40 grams of fentanyl, enough to kill more than 13,000 people, in Hardy County in January 2020.
The fentanyl distribution operation involved Rutherford and others, who distributed the deadly substance in the region. The operation had a significant impact on the community, with many people affected by the distribution of the substance.
The case was prosecuted by Assistant U.S. Attorney Stephen D. Warner on behalf of the government. The Potomac Highlands Drug & Violent Crimes Task Force, a HIDTA-funded initiative, investigated the case. The task force is comprised of the DEA, the FBI, the West Virginia State Police, the Mineral County Sheriff’s Office, the Hampshire County Sheriff’s Office, the Hardy County Sheriff’s Office, the Grant County Sheriff’s Office, and the Keyser Police Department.
U.S. District Judge Thomas S. Kleeh presided over the case. Rutherford’s sentencing brings an end to a lengthy investigation and prosecution, and serves as a reminder of the dangers of fentanyl distribution and the consequences of those who engage in it.
The case is a prime example of the ongoing efforts by law enforcement to combat the opioid crisis and bring those responsible to justice. The investigation and prosecution of Rutherford and others involved in the operation demonstrate the commitment of the authorities to protecting the community and keeping it safe.
