Child Predator Caught: 46-Year-Old Bronx Man Charged with Possession of Child Pornography

Juan Tomas Diaz, a 46-year-old Bronx resident, has been charged with one count of possessing child pornography, according to the United States Attorney for the Southern District of New York, Damian Williams. Diaz will be presented later today before U.S. Magistrate Judge Sarah L. Cave.

Williams described Diaz as a child predator who had access to a daycare facility located in the same building as his basement apartment. The daycare is run by a family member of Diaz, and 11 children are currently enrolled. Diaz allegedly possessed over 100 images and videos of child pornography, including graphic content of children being raped and engaging in other sexual conduct.

Acting Special Agent in Charge Erin Keegan praised the investigative work of HSI New York’s Child Exploitation Investigations Team and the U.S. Attorney’s Office for the Southern District of New York. Keegan said, ‘Every parent’s worst nightmare, the defendant had access to a childcare facility where toddlers’ and young adolescents’ loved ones expected they would be safe.’

Diaz was arrested yesterday after federal agents executed a judicially authorized search warrant of his apartment. The agents seized and searched his phone, which contained the alleged child pornography. Diaz subsequently waived his Miranda rights and signed a written consent form, admitting to viewing videos and images of minors engaged in sexual activity.

Diaz is charged with one count of possession of child pornography, which carries a maximum sentence of 10 years in prison. He is currently being held without bail. The investigation is ongoing, and anyone with information about Diaz’s conduct is urged to call HSI at 1-877-4-HSI-TIP.

The charges contained in the Complaint are merely accusations, and the defendant is presumed innocent unless and until proven guilty. The case is being handled by the Office’s General Crimes Unit, with Assistant U.S. Attorney Lauren E. Phillips in charge of the prosecution.
