Kelly Romero, Assault with a Dangerous Weapon, South Dakota 2013

Cherry Creek Man Sentenced for Assault with a Dangerous Weapon

A Cherry Creek man has been sentenced to 14 months in custody for Assault with a Dangerous Weapon, a federal crime. Kelly Romero, 27, was found guilty of the offense and sentenced by U.S. District Judge Roberto A. Lange on December 15, 2014.

According to the investigation, the incident occurred on May 16, 2013, when Romero got into an argument with his brother at his home. Romero, who had been drinking, picked up a sawed-off shotgun and pointed it at his brother, threatening to shoot him unless he left the house.

The case was investigated by the Cheyenne River Sioux Tribe Law Enforcement Services and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant U.S. Attorney Mikal Hanson prosecuted the case.

Romero was immediately turned over to the custody of the U.S. Marshals Service after the sentencing. He will also serve 18 months of supervised release and pay a $100 special assessment to the Federal Crime Victims Fund.

The conviction stems from Romero’s guilty plea on September 22, 2014, following an indictment by a federal grand jury on July 17, 2013.

U.S. Attorney Brendan V. Johnson announced Romero’s sentence, highlighting the severity of the offense and the importance of holding individuals accountable for violent crimes.
