Kenneth Manuel Aguirre, Fentanyl Trafficking and Firearm Offenses, New Mexico 2023

A 26-year-old Las Cruces felon has been charged in federal court with fentanyl trafficking and multiple firearm offenses after allegedly threatening victims with a handgun and later possessing more than 40 grams of fentanyl while armed.

Kenneth Manuel Aguirre, 26, of Las Cruces, was taken into custody on outstanding warrants issued by the United States District Court for the District of New Mexico.

According to court documents, Aguirre was arrested after allegedly threatening two victims with a handgun during a dispute. When law enforcement officers executed a search warrant at his residence, they found over 40 grams of fentanyl and a handgun.

The charge of fentanyl trafficking carries a statutory maximum penalty of 20 years in prison and a $1,000,000 fine. The charge of possession of a firearm in furtherance of a drug trafficking crime carries a statutory maximum penalty of 10 years in prison and a $250,000 fine.

Aguirre will make his initial appearance in federal court in the District of New Mexico on February 10, 2023.

The case was investigated by the United States Drug Enforcement Administration and the Las Cruces Police Department. The case is being prosecuted by Assistant United States Attorney Andrew L. Bustamante.

Aguirre is presumed innocent until proven guilty in a court of law. The public is reminded that an indictment is merely an accusation and does not constitute proof of guilt.”
