Brooklyn, NY – In a move aimed at ensuring the integrity of the justice system, U.S. Attorney Damian Williams, HSI Acting Special Agent in Charge Erin Keegan, and NYPD Commissioner Edward A. Caban announced the unsealing of a Complaint charging Leo Hernandez with obstruction of justice in connection with his October 2022 sentencing proceeding in a federal narcotics case.
Hernandez, 42, of Staten Island, New York, allegedly obstructed the sentencing proceeding by providing false information to the U.S. Probation Office and his attorney, including a claim of an opioid addiction, in an attempt to obtain leniency at sentencing.
A second defendant, Obioma Iwobi, has also been charged with obstruction of justice in connection with his March 2023 sentencing proceeding in a federal fraud case.
The obstruction of justice charges carry a maximum sentence of 20 years in prison for each defendant.
According to the allegations in the Complaint charging Hernandez and the Indictment charging Iwobi, Hernandez was prosecuted for participating in a conspiracy to distribute narcotics in United States v. Leo Hernandez, No. 20 Cr. 79 (RMB), and Iwobi was prosecuted for participating in a fraud and identity theft scheme in United States v. Obioma Iwobi, No. 22 Cr. 652 (ER).
The defendants will be presented before the Honorable Sarah Netburn and the Honorable Naomi Reice Buchwald, respectively.
Hernandez is currently being held without bail, while Iwobi is currently incarcerated in Seagoville, Texas.
