New York – In a resounding victory for public safety, Attorney General Letitia James successfully defended the city’s stringent gun control measures today. The U.S. Court of Appeals for the Second Circuit upheld New York’s ban on firearms in Times Square and public transit systems, rejecting challenges from Frey v. City of New York.
“New Yorkers deserve to feel safe on public transportation and everywhere in our state,” James stated. “Today’s decision affirms that right. Common-sense gun laws save lives, keep guns out of sensitive community spaces, and help address the gun violence crisis.”
The court’s ruling came after a successful defense of other provisions of New York’s Concealed Carry Improvement Act (CCIA) in October 2024. The CCIA bans concealed carry in sensitive areas such as Times Square and on public transit, aiming to protect communities from potential harm.
In rejecting the challenge, the court affirmed the denial of a preliminary injunction, emphasizing the necessity of such laws in maintaining order and safety within the city’s bustling streets and transit networks.
James has been a relentless advocate for common-sense gun laws, ensuring that New York remains one of the safest states in the nation. Her office will continue to defend these laws, safeguarding New Yorkers from the perils of gun violence.
This victory is a testament to the effectiveness of New York’s gun control measures and the commitment of its leaders to protect public safety.
