Lexington Doc Fines $200K for Fudging Records

OKLAHOMA CITY – In a shocking display of medical malfeasance, Lexington physician James K. Robberson, M.D. (49) has copped to a $200,000 fine for failing to keep records straight on his Schedule II-controlled substance purchases.

As a registered dealer under the Comprehensive Drug Abuse Prevention and Control Act of 1970, Robberson was required to maintain accurate records of his controlled substance transactions. But according to the U.S. Department of Justice, the good doc had other plans.

The allegations, which span from May 5, 2021, to February 6, 2023, claim that Robberson repeatedly failed to keep copies of DEA Form 222, a crucial document required for purchasing Schedule II controlled substances. This blatant disregard for the law not only put his patients at risk but also opened the door for potential diversion and loss of controlled drugs.

“Recordkeeping is a vital part of managing controlled substances,” said U.S. Attorney Robert J. Troester. “Complete and accurate records help avoid diversions and losses of controlled drugs.” But in Robberson’s case, it seems that keeping records just wasn’t his thing.

The U.S. Attorney’s Office for the Western District of Oklahoma announced the settlement, which was reached after a thorough investigation by the Drug Enforcement Administration, Office of Diversion Control. Assistant U.S. Attorneys Amanda R. Johnson and Ronald R. Gallegos prosecuted the case.

While Robberson agreed to cough up the $200,000 fine, he did not admit liability and the government did not make any concessions about the legitimacy of the claims. The agreement allows the parties to avoid the delay, expense, inconvenience, and uncertainty involved in litigating the case.

The case serves as a stark reminder of the importance of adhering to federal regulations, especially when it comes to controlled substances. As the U.S. Attorney’s Office so aptly put it, “Recordkeeping is a vital part of managing controlled substances.”

The investigation into Robberson’s activities is ongoing, and we’ll be keeping a close eye on this developing story.

Dr. James K. Robberson, M.D. is a Lexington, Oklahoma resident and practicing physician. He has been ordered to pay $200,000 in fines for his role in violating federal regulations regarding controlled substance recordkeeping.
