Lincoln Memorial Vandal Indicted
A 26-year-old Washington D.C. man has been indicted on federal charges for vandalizing the Lincoln Memorial during protests in May 2020. Micah Avery was accused of spray-painting the iconic landmark with the words ‘Yall not tired yet?’ in black spray paint.
According to the indictment, officers with the U.S. Park Police witnessed Avery graffiti the words on the memorial on the afternoon of May 30, 2020. Avery fled as the officers approached him and led them on a chase, eventually being apprehended and handcuffed.
However, Avery resisted the officers’ attempts to put him in a patrol car and a crowd converged on the scene, pushing and striking the officers. During the melee, Avery broke free and ran away, leaving one officer with an injured hand.
A look-out was broadcast, and Avery was located shortly thereafter by other officers back at the Lincoln Memorial, still wearing the handcuffs.
An indictment is a formal accusation of criminal conduct for purposes of establishing probable cause, not evidence of guilt. The defendant is presumed innocent unless proven guilty.
“Defacing one of our country’s national monuments will not be tolerated,” said Acting U.S. Attorney Michael R. Sherwin. “We will not stand idly by while our nation’s landmarks are desecrated.”
The case is being prosecuted by Assistant U.S. Attorney James B. Nelson of the U.S. Attorney’s Office for the District of Columbia, and Acting U.S. Attorney Sherwin commended the work of the USPP officers who apprehended Avery and are investigating the incident.
