ALBANY, NEW YORK – A 59-year-old sex offender from Treadwell, New York, has pleaded guilty to failing to register an email address as required under the Sex Offender Registration and Notification Act.

Michael J. Frascatore, who was convicted in federal court in 2008 for distributing child pornography, admitted to creating an email address in April 2019 and maintaining it for approximately four years without disclosing it to authorities.

The United States Attorney’s Office for the Northern District of New York announced that Frascatore pleaded guilty to violating the Sex Offender Registration and Notification Act (SORNA) and to violating the terms of his supervised release.

According to the indictment, Frascatore was required to report, among other things, all email addresses he used. He failed to disclose his email address to U.S. Probation and used an unauthorized internet-capable phone to maintain the undisclosed email account.

Furthermore, Frascatore admitted to knowingly communicating with minors online, including by sending explicit photos of himself to minors and requesting nude photos in return.

Frascatore will be sentenced for the SORNA offense and for his violations of supervised release on May 2, 2024, by United States District Judge Anne M. Nardacci. The SORNA offense carries a maximum term of 10 years in prison, a fine of up to $250,000, and a term of supervised release of at least 5 years and up to life.

The United States Marshals Service investigated this case, which is being prosecuted by Assistant United States Attorney Michael F. Perry as part of Project Safe Childhood.
