Three Indicted in South Dakota Burglary Case
A federal grand jury in South Dakota has indicted three individuals for their alleged role in a downtown business burglary. Jake Morrison, 31, Nicholas Guttierrez, 19, and Stephanie Vandervier, 27, all from Timber Lake, are accused of breaking into the Chatter Box Bar and Cafe on January 6, 2013.
According to the indictment, Morrison, Guttierrez, and Vandervier face a maximum penalty of 10 years in custody, a $250,000 fine, or both, as well as 3 years of supervised release and a $100 special assessment. Restitution may also be ordered.
The charges are merely an accusation, and Morrison, Guttierrez, and Vandervier are presumed innocent until and unless proven guilty. A trial date has not been set.
The investigation into the alleged break-in is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Division. Assistant U.S. Attorney Mikal Hanson is prosecuting the case.
Morrison was remanded to the custody of the U.S. Marshal, while Guttierrez and Vandervier were released on bond pending trial.
