Orangevale Man Jailed for Distributing Child Porn
A 35-year-old Orangevale man has pleaded guilty to distributing child pornography, making him eligible for up to 20 years in prison.
Daniel Wayne Benner was arrested in 2019 for distributing a video and images depicting minors engaging in sexually explicit conduct via the Kik Messenger app to a person in Arkansas.
According to court documents, Benner used his smartphone, the internet, and the Kik Messenger app to distribute the child pornography over three days in July 2019.
Bennet’s publicly accessible Facebook profile, which included a picture of him in a “My Little Pony” costume, raised suspicions among investigators. He initially claimed he and two friends were starting a birthday party business, but were unable to secure any customers.
The case was investigated by the FBI and the Internet Crimes Against Children Task Force, a federally and state-funded task force managed by the Sacramento Sheriff’s Department with agents from federal, state, and local agencies.
Assistant U.S. Attorney Christina McCall is prosecuting the case, which is part of Project Safe Childhood, a nationwide initiative launched in May 2006 to combat the growing epidemic of child sexual exploitation and abuse.
Bennet is scheduled to be sentenced by U.S. District Judge Kimberly J. Mueller on October 25, 2021. He faces a mandatory minimum sentence of five years and a maximum statutory penalty of 20 years in prison, a $250,000 fine, and up to a lifetime of supervised release.
The actual sentence will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines.
