Acting United States Attorney Michael M. Simpson announced that MARCELO ORDONEZ-RIVAS, 46, a Honduran national, has been indicted for illegal re-entry of a removed alien, in violation of Title 8, United States Code, Section 1326(a).
ORDONEZ-RIVAS was discovered in Jefferson Parish, Louisiana, on June 18, 2025. He had earlier been convicted and sentenced for the same offense in 2016, following his removal to Honduras.
According to court documents, ORDONEZ-RIVAS, an illegal alien, has now been charged with violating U.S. Code Section 1326(a). If convicted, he faces a maximum penalty of ten years imprisonment, a $250,000 fine, three years of supervised release, and a mandatory special assessment fee of $100.
Acting U.S. Attorney Simpson emphasized that an indictment is merely a charge, and the guilt of the defendant must be proven beyond a reasonable doubt. The case is part of Operation Take Back America, a nationwide initiative aimed at combating illegal immigration, eliminating cartels and transnational criminal organizations, and protecting communities from violent crime.
Operation Take Back America leverages resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN). Simpson commended U.S. Customs and Border Protection for their role in investigating this case. Special Assistant United States Attorney Frederick W. Veters Jr., overseeing the prosecution, is part of the General Crimes Unit.
This grim reminder of America’s ongoing immigration challenges underscores the federal government’s commitment to upholding immigration laws and protecting public safety.
