Porcupine Man Gets Year for Assault
Leo Kills Back, a 32-year-old Porcupine, South Dakota, man, was sentenced to a year in custody for brutally assaulting his sister.
According to court records, Kills Back, on July 20, 2013, hit his sister several times on the head with a shovel at Evergreen, leaving her with serious bodily injury.
Kills Back was initially charged with Assault with a Dangerous Weapon and Assault Resulting in Serious Bodily Injury by a federal grand jury on September 24, 2013. He later pleaded guilty to Assault by Striking, Beating, or Wounding on December 12, 2013.
The investigation into the assault was conducted by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety. Assistant U.S. Attorney Kathryn N. Rich prosecuted the case.
U.S. Magistrate Judge Veronica L. Duffy handed down the sentence on February 27, 2014. In addition to the one-year prison term, Kills Back was also ordered to serve one year of supervised release and pay a $25 special assessment to the Federal Crime Victims Fund.
Kills Back was immediately taken into custody by the U.S. Marshals Service following the sentencing. The case serves as a stark reminder of the devastating consequences of domestic violence and the importance of holding perpetrators accountable for their actions.
