BUFFALO, N.Y. – Andre Ali, 27, a citizen of Guyana, proved just how desperate some are to avoid facing the consequences of unlawful presence in the United States. He was arrested and charged with escape from custody after a bizarre and brazen attempt to flee authorities at the Rainbow Bridge Port of Entry in Niagara Falls. If convicted, Ali faces a maximum penalty of one year in prison and a $100,000 fine.

The incident unfolded in the early morning hours of September 1, 2025. Customs and Border Protection (CBP) officers encountered Ali driving a vehicle that mistakenly entered the Rainbow Bridge from the U.S. side. He had no identification on him. A secondary inspection quickly revealed Ali had overstayed his welcome – admitted as a visitor in April 2018, his authorized stay expired October 15, 2018. He wasn’t just a visitor anymore; he was unlawfully present in the country.

Handcuffed, Ali was placed in a secure room while officers processed his administrative details. It didn’t take long for him to attempt a desperate escape. According to authorities, after an officer informed Ali he would be detained and see a judge, and barely a minute after the officer departed, Ali scaled a bench and squeezed into the ceiling cavity. This wasn’t a slow burn; it was a calculated risk, a frantic dash for freedom.

The attempt, however, was short-lived. Ali soon crashed through the ceiling into an adjacent room, where he attempted to hide under a shelf. CBP officers quickly discovered the escape and swiftly regained physical control of Ali. The entire sequence, from informing him of detention to recapture, occurred with alarming speed. It’s a testament to both Ali’s audacity and the officers’ quick response.

Special Assistant U.S. Attorney Michael J. Smith is prosecuting the case. This isn’t an isolated incident, the Department of Justice asserts. It’s part of “Operation Take Back America,” a sweeping nationwide initiative aimed at bolstering border security, dismantling cartels and transnational criminal organizations (TCOs), and protecting communities from violent crime. The investigation was led by Customs and Border Protection, under the direction of Director of Field Operations Rose Brophy.
