WHEELING, WEST VIRGINIA – Randolph Michael Smith, a 42-year-old man from Wheeling, West Virginia, has admitted to a firearms charge, Acting United States Attorney Randolph J. Bernard announced.
Smith pleaded guilty today to one count of “Unlawful Possession of a Firearm,” a charge that carries significant consequences. As a person prohibited from having firearms due to prior convictions, Smith admitted to having a 9mm semi-automatic pistol in August 2020 in Ohio County.
The prosecution was handled by Assistant U.S. Attorney Clayton J. Reid on behalf of the government. The Bureau of Alcohol, Tobacco, Firearms, & Explosives and the Wheeling Police Department conducted the investigation.
Smith now faces up to 10 years of incarceration and a fine of up to $250,000. The actual sentence will be determined by the Federal Sentencing Guidelines, taking into account the seriousness of the offenses and Smith’s prior criminal history.
The case was presided over by U.S. Magistrate Judge James P. Mazzone.
As a result of his guilty plea, Smith’s future is uncertain. The court will determine the final sentence, but it is clear that he has admitted to a serious crime. This case serves as a reminder of the consequences of violating firearms laws in the United States.
