Rosebud Woman Charged with Healthcare Fraud

A 38-year-old Rosebud woman has been indicted for acquiring controlled substances by fraud and theft in connection with healthcare.

According to the indictment, Bonnie Melissa Levy knowingly and intentionally acquired and obtained possession of controlled substances, including Morphine, between January 1, 2013, and October 30, 2013. The investigation revealed that Levy embezzled, stole, and converted Morphine and Benadryl, valued at less than $100, which were the property of the Rosebud Indian Health Services Facility, a healthcare benefit program in Rosebud.

The maximum penalty upon conviction is up to 4 years in custody and/or a $250,000 fine, 1 year of supervised release, and $125 to the Federal Crime Victims Fund. Restitution may also be ordered.

Levy appeared before U.S. Magistrate Judge Mark A. Moreno on December 11, 2013, and pled not guilty to the indictment. She was released on bond pending trial, with a trial date yet to be set.

The investigation is being conducted by the Office of the Inspector General. Assistant U.S. Attorney Jay Miller is prosecuting the case.

United States Attorney Brendan V. Johnson announced the indictment, emphasizing that the charges are merely accusations and that Levy is presumed innocent until proven guilty.

The case highlights the importance of monitoring healthcare benefits programs to prevent theft and fraud.

Levy’s case is a stark reminder that those who abuse their positions of trust to embezzle and steal will face consequences.
