John Damian, Felon in Possession of a Firearm, California 2023

SACRAMENTO, Calif. — A grim day in court for John Damian, a 30-year-old Sacramento native who pleaded guilty today to being a felon in possession of a firearm. The U.S. Attorney Phillip A. Talbert dropped the charges.

According to court documents, on Nov. 8, 2023, law enforcement came face-to-face with Damian and an armed robbery suspect. On parole for multiple felonies, Damian was legally subject to search. He tried to sidestep officers but ultimately admitted to carrying a Glock 27 semi-automatic firearm. The firearm held a 13-round magazine loaded with .40 caliber ammunition, though no round was in the chamber.

In his left pocket, detectives found over 20 grams of cocaine. Damian’s rap sheet is lengthy, including convictions for assault with force likely to produce great bodily injury, assault on person with a semi-automatic firearm, and willful discharge of a firearm in a negligent manner.

Scheduled for sentencing before U.S. District Judge William B. Shubb on Aug. 26, 2024, Damian faces up to 15 years in prison and a $250,000 fine. His fate lies in the hands of the court, which will consider Federal Sentencing Guidelines.
