Las Cruces Man Pleads Guilty to Production of Child Pornography

A 28-year-old man from Las Cruces, New Mexico, has pleaded guilty to producing child pornography. Sean Patrick Fosler will remain in custody pending sentencing, which has not been scheduled, according to a federal court plea agreement.

On May 7, 2021, Fosler recorded a video of an eight-year-old child engaged in sexually explicit conduct. Fosler also appears in the video engaged in sexual conduct. The video was sent to a person in Texas using Snapchat.

Fosler’s plea agreement states that he used Snapchat to send the video to an individual in Texas. The production of child pornography is a serious crime that carries a significant sentence. Fosler faces a minimum of 15 years and up to 30 years in prison.

The investigation into Fosler’s activities was conducted by Homeland Security Investigations (HSI) with the assistance of the New Mexico State Police and the El Paso Police Department. Assistant United States Attorney Marisa A. Ong is prosecuting the case as part of Project Safe Childhood, a nationwide initiative launched in May 2006 to combat the growing epidemic of child sexual exploitation and abuse.
