Sexual Assault Convictions Hit Homelands
McLaughlin Man And Wakpala Man Sentenced For Sexual Contact With A Person Incapable Of Consenting.
Joseph Mark Eagle, 28, of McLaughlin, South Dakota, and Justin Howard, 31, of Wakpala, South Dakota, were convicted of Sexual Contact with a Person Incapable of Consenting, a serious crime that violates a person’s autonomy and dignity.
The convictions stem from an assault which occurred on August 2, 2008, when both Eagle and Howard sexually assaulted an adult female who was incapable of appraising the nature of the sexual contact and was physically incapable of declining participation in the sexual contact.
Eagle was sentenced to 12 months and a day of custody, 5 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund. Howard was sentenced to 18 months of custody, 5 years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund.
Assistant U.S. Attorney Mikal Hanson prosecuted the case, which was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs, Standing Rock Law Enforcement Agency. The men were immediately turned over to the custody of the U.S. Marshals Service to begin serving their sentences.
This case highlights the importance of holding perpetrators accountable for their crimes, particularly those that involve vulnerable individuals. The victims and their families deserve justice and closure, and it is the duty of law enforcement and the justice system to ensure that those responsible are brought to justice.
