St. Francis Man Charged with False Statements and Fraud

A St. Francis, South Dakota man has been charged with making false statements and attempting to obtain a controlled substance by fraud. Titus James Iron Shield, 48, was indicted by a federal grand jury on January 15, 2014, for his alleged involvement in a health care scam.

According to the indictment, Iron Shield presented a forged prescription to a pharmacy on April 30, 2013, to obtain Hydrocodone pills, knowing the prescription was falsified. This is not the first time Iron Shield has found himself in hot water – he appeared before U.S. Magistrate Judge Mark A. Moreno on January 23, 2014, and pled not guilty to the indictment.

The maximum penalty for conviction is up to 5 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered, depending on the outcome of the trial.

The investigation is being conducted by the Office of the Inspector General – Department of Health and Human Services. Assistant U.S. Attorney Tim Maher is prosecuting the case. Iron Shield was remanded to the custody of the U.S. Marshals Service pending trial, with no date set.

The charges against Iron Shield are merely an accusation, and he is presumed innocent until proven guilty in a court of law. The U.S. Attorney’s office is urging anyone with information about the case to come forward.
