Suffolk Man Faces Heroin Indictment
NORFOLK, Va. – A Suffolk man was indicted by a federal grand jury on charges of distributing heroin resulting in death, distributing heroin resulting in serious bodily injury, distributing heroin, and distributing fentanyl.
Carlos A. Brown, 45, of Suffolk, was taken into custody on charges that he knowingly distributed heroin and fentanyl to individuals, resulting in a fatal overdose and serious bodily injury to others.
According to the indictment and documents filed with the court, the investigation into Brown’s drug activities began in November 2015 after an overdose death in Chesapeake. Over the next six months, law enforcement officials gathered evidence through confidential human source interviews, undercover controlled buys, and physical surveillance.
Documents reveal that Brown told a confidential source that he was aware of at least three or four of his customers overdosing, yet he continued to sell heroin. The day after learning of the fatal overdose, Brown continued to sell the deadly substance.
Brown faces a mandatory minimum sentence of 20 years in prison and a maximum penalty of life in prison if convicted. The maximum statutory sentence is prescribed by Congress, but the actual sentence will be determined by the court based on the advisory Sentencing Guidelines and other factors.
The case is being prosecuted by Special Assistant U.S. Attorney John F. Butler, and Assistant U.S. Attorneys Andrew C. Bosse and Joseph E. DePadilla. The investigation was led by the FBI’s Norfolk Field Office, the Virginia State Police, and the Chesapeake Police Department.
An indictment contains allegations that a defendant has committed a crime. Every defendant is presumed innocent until proven guilty in court.
