Eagle Butte Man Charged with Assaulting a Federal Officer

A disturbing incident of violence against law enforcement has shaken the community of Eagle Butte, South Dakota. Thomas James Shan Looking Horse, a 31-year-old resident of the town, has been charged with Assaulting, Resisting, Opposing, and Impeding a Federal Officer.

According to the indictment, Looking Horse forcibly assaulted, resisted, opposed, impeded, intimidated, and interfered with a Police Sergeant and a Correctional Officer from the Cheyenne River Sioux Tribe on December 19, 2016, while they were performing their official duties.

The maximum penalty upon conviction is up to 20 years in custody and/or a $250,000 fine, 3 years of supervised release, and $200 to the Federal Crime Victims Fund. Restitution may also be ordered.

The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Jay Miller is prosecuting the case.

Looking Horse was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set. The charges are merely accusations, and Looking Horse is presumed innocent until and unless proven guilty.
