Three convicted sex offenders—McKENNA DANILO BERNARDO, 23, of Burien; JASON ALLEN LEGG, 44, of Seattle; and DAVID CRAIG MARTIN, 64, of Seattle—are back behind bars or under federal supervision after being indicted for possessing graphic images of child rape and abuse. All three have prior convictions for sex crimes against minors, and all were under active monitoring when investigators uncovered new evidence of illegal activity on unauthorized electronic devices.
BERNARDO was charged April 30, 2020, after a February 2019 home inspection revealed prohibited electronics. A forensic sweep uncovered child pornography on the devices. In 2019, he had already served 14 months in prison and was sentenced to three years of probation for a prior child pornography conviction. His current release is under strict federal pretrial supervision, despite repeated violations of device-use restrictions.
LEGG, previously sentenced to ten years in prison for rape of a child in King County Superior Court in 2005, was also charged April 30, 2020. His criminal history includes a 1998 conviction in Georgia. In November 2018, his probation officer flagged an unauthorized Facebook account. Follow-up by the Seattle Police Department uncovered multiple unapproved devices, some containing explicit material depicting child rape and abuse. LEGG remains in custody with the Washington State Department of Corrections.
MARTIN, a serial offender with convictions for Child Molestation 3rd Degree (2001), Indecent Exposure (2009, 2015), and Voyeurism (2016), was charged May 14, 2020. The case began when Google flagged over 175 child pornography images uploaded from an account linked to him. Investigators from the Seattle Police Internet Crimes Against Children Task Force and the Department of Corrections seized devices from MARTIN, which Homeland Security Investigations later confirmed contained illegal material.
All three cases were investigated by Homeland Security Investigations, working closely with the Seattle ICAC Task Force and the Washington State Department of Corrections. The indictments underscore the ongoing threat posed by repeat offenders exploiting digital access to commit new crimes against children—often while under court-mandated supervision meant to prevent exactly that.
Possession of child pornography carries a maximum 20-year sentence, with a mandatory 10-year minimum for defendants with qualifying prior sex offenses. Assistant U.S. Attorney Cecelia Gregson is prosecuting. The charges are pending; each defendant is presumed innocent until proven guilty beyond a reasonable doubt in federal court.
