Oglala Man Sentenced For Assault Resulting In Serious Bodily Injury

A brutal assault at a Super Bowl party has landed Oglala, South Dakota, resident Tristan Yellow Horse in hot water. The 27-year-old was sentenced to 18 months’ imprisonment for Assault Resulting In Serious Bodily Injury, a federal crime.

According to prosecutors, the victim and others were drinking and watching the Super Bowl at the victim’s house on February 7, 2011. Yellow Horse showed up at the victim’s house following the game and was eventually asked to leave. But instead of departing peacefully, Yellow Horse punched the victim in the face and knocked him to the ground, causing a dislocated shoulder and extreme pain.

Yellow Horse, who pled guilty on March 8, 2013, was sentenced by Chief Judge Jeffrey L. Viken on July 8, 2013. In addition to the 18-month prison sentence, Yellow Horse was ordered to pay $100 to the Federal Crime Victims Fund.

The case was investigated by the Bureau of Indian Affairs Office of Justice Services and the Oglala Sioux Tribe Department of Public Safety. Assistant U.S. Attorney Sarah B. Collins prosecuted the case.

Yellow Horse’s sentence sends a clear message that violent crime will not be tolerated in our communities. The victim of this assault suffered a serious injury and will likely require ongoing medical care.
