ALBUQUERQUE – In a gritty turn of justice, Dawayne Yates, 53, was sentenced to 66 months in federal prison after pleading guilty to the armed robbery of Big 5 Sporting Goods Federal Firearms Licensee (FFL) on April 28, 2022. The sentence comes with no possibility of parole.
According to court documents, Yates entered the store under the guise of inspecting a rifle and was handed a Ruger Mini-14 by an employee. He then brandished a handgun, terrorizing the worker into surrendering a Dickinson XX3D-M-2 shotgun. With both firearms stuffed into a stolen gun case from the store, Yates fled in a vehicle with no license plate.
Fingerprint evidence and a victim identification through a lineup led to Yates’ arrest on May 2nd. Upon his capture at a local motel, police recovered a 9mm Taurus pistol, a .22 caliber Remington rifle, ammunition, body armor, and suspected fentanyl pills.
Despite his prior felony convictions, which should have prohibited him from possessing firearms or ammunition, Yates was caught with the stolen goods. The Big 5 Sporting Goods’ firearms were not recovered.
Following his release from prison, Yates will be under supervised release for five years. U.S. Attorney Alexander M.M. Uballez and Special Agent in Charge Brendan Iber of the ATF’s Phoenix Field Division announced the sentencing today. The ATF and Albuquerque Police Department collaborated on the investigation, with Assistant United States Attorney Patrick E. Cordova prosecuting the case.
