New York Attorney General Letitia James’ Office of Special Investigation (OSI) has released a report concluding that the shooting death of Anthony Zaremski by a Saratoga County Sheriff’s Office (SCSO) deputy was justified under New York law.
The incident, which occurred on May 23, 2023, in Clifton Park, involved SCSO’s special operations team executing a federal search warrant at Zaremski’s apartment. The team entered the apartment to secure it for DEA agents and were met with gunfire from Zaremski. In self-defense, the lead deputy returned fire, ultimately killing Zaremski.
After reviewing body-worn camera footage, interviews, and legal analysis, OSI determined that a prosecutor would not be able to disprove beyond a reasonable doubt that the officer’s use of deadly force was justified. Under New York law, an officer may use deadly physical force when reasonably believing it is necessary to defend against the use of deadly force by another.
OSI also recommended that SCSO require its special operations team members to equip themselves with and activate body-worn cameras during all public encounters unless confidentiality is required. They suggest on-site commanders direct deactivation of audio but maintain video in such cases.
The OSI’s findings were in line with the lead deputy’s perception of being in danger, as evidenced by Zaremski’s initial firing at him and grazing other officers’ helmets and protective gear. As a result, no criminal charges will be pursued in this matter.
