Greater Providence YMCA, Disability Discrimination, Providence RI, 2024
A shocking case of disability discrimination has come to light in Providence, Rhode Island, with the Greater Providence YMCA agreeing to settle allegations of violating the Americans with Disabilities Act (ADA).
The U.S. Attorney’s Office, led by Zachary A. Cunha, announced the settlement, which resolves a complaint filed by the parent of a child with cystic fibrosis. The parent alleged that the YMCA refused to make a reasonable modification of its medication administration policy, denying her child the opportunity to attend Camp Fuller in the summer of 2023.
According to the investigation, the parent had enrolled her child at Camp Fuller in the summer of 2022, where staff allowed the child to self-administer pancreatic enzyme supplements. However, when the parent re-enrolled her child in the summer of 2023, the YMCA refused to permit the child to self-administer his medication, citing a medication administration policy that it refused to modify.
Under the terms of the settlement agreement, the Greater Providence YMCA will take several remedial measures, including training its staff on the requirements of the ADA, evaluating accommodation requests on a case-by-case basis, and adopting a non-discrimination policy.
The settlement also requires the YMCA to pay $10,000 in compensation to the complainant and allow her son to attend Camp Fuller for all summers in which he is eligible. Additionally, the YMCA will be required to report to the U.S. Attorney’s Office on its compliance annually for two years.
This is the third settlement agreement that the U.S. Attorney’s Office has entered into with a camp regarding violations of the ADA. Under the ADA, summer camps must afford reasonable modifications to ensure that children with disabilities can participate fully in camp programs and activities.
