Eric Rivera, a 39-year-old from Niagara Falls, NY, has been sentenced to 70 months in prison for possession with intent to distribute over 400 grams of fentanyl and being a felon in possession of ammunition. The sentencing follows a search warrant executed by the Niagara Falls Police Department on March 14, 2024, at an Ontario Avenue residence, where Rivera was seen throwing a shopping bag over a fence and attempting to hide. The search uncovered approximately 18 grams of cocaine and fentanyl, 642 grams of heroin and fentanyl, and 1511 grams of fentanyl, as well as a firearm and ammunition.
Rivera, who was previously convicted in Erie County Court of Criminal Possession of a Controlled Substance in the 5th Degree in 2007, is legally prohibited from possessing a firearm. The investigation was led by the Niagara Falls Police Department and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), with Assistant U.S. Attorney P. Richard Antoine handling the case.
The large quantities of narcotics and the presence of a firearm made this a serious offense, with significant consequences for Rivera. The sentencing is a result of the collaborative efforts of local and federal law enforcement agencies to combat drug trafficking and gun violence in the Buffalo area.
