RALEIGH, N.C. – Adam Mitchum Bailey, a 44-year-old resident of Whispering Pines and already a registered sex offender, is headed back to prison after receiving a 10-year sentence for possession of child pornography. This isn’t Bailey’s first rodeo; he was previously convicted on similar charges in October of 2018, demonstrating a disturbing pattern of behavior.
The latest charges against Bailey surfaced in March of 2021. He ultimately pled guilty on August 22, 2022, to the possession of abhorrent material. U.S. District Judge James C. Dever III handed down the 120-month sentence today, acknowledging Bailey’s status as a repeat offender, triggering enhanced penalties under federal law.
Court records reveal a brazen disregard for the law. Bailey was initially sentenced in March 2019 to 24 months in the Bureau of Prisons (BOP) followed by 10 years of supervised release. Released in November 2020 after serving time at the Austin Wilkes Society re-entry facility in Fayetteville, North Carolina, Bailey’s freedom was short-lived. Just days before his release, staff discovered an unauthorized cellphone on his bed – a device brimming with images of child pornography. Evidence confirmed the phone belonged to him.
The illicit phone wasn’t an isolated incident. Authorities also confiscated a second cellphone from Bailey weeks prior. Both devices were turned over to the North Carolina State Bureau of Investigation Computer Crimes Unit, and both were found to contain sickening images of child pornography, including depictions of children under the age of 12. During questioning, Bailey admitted to actively seeking out this material online using both phones.
“This individual has demonstrated a clear and dangerous propensity for exploiting vulnerable children,” stated Michael Easley, U.S. Attorney for the Eastern District of North Carolina. “Our office will continue to aggressively prosecute those who engage in this horrific crime and ensure they are held accountable.” The investigation was a joint effort between the North Carolina State Bureau of Investigation Computer Crimes Unit and the Bureau of Prisons.
