A brazen attempted drive-by shooting in East Baltimore has led to a 54-month prison sentence for James Beverly, 40. The incident occurred in February 2024, when Beverly, who was prohibited from possessing a firearm due to prior felony convictions, was targeted by a gunman in a dark-colored SUV. Beverly, who had his pockets filled with fentanyl and cocaine base packaged for distribution, returned fire after being shot at.
Beverly’s prior convictions include first-degree murder and attempted second-degree murder, making him a prohibited person in possession of a firearm. The loaded semi-automatic pistol he used during the shootout was a key factor in his sentencing.
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Baltimore Police Department (BPD) collaborated on the investigation, which resulted in Beverly’s sentence. U.S. District Judge Matthew J. Maddox handed down the sentence, which includes three years of supervised release.
U.S. Attorney Kelly O. Hayes emphasized the importance of holding violent offenders accountable, stating that drive-by shootings create fear, violence, and instability in neighborhoods. Hayes also noted that the federal sentence ensures there is no possibility of parole for Beverly.
