Bribery Scandal Rocks Amec Foster Wheeler

New York-based Amec Foster Wheeler Energy Limited has agreed to pay a penalty of more than $18 million to resolve charges stemming from the company’s involvement in a scheme to pay bribes to foreign officials in Brazil in exchange for a lucrative contract.

According to court documents, between 2011 and 2014, Amec Foster Wheeler conspired with others, including an Italian sales agent affiliated with a Monaco-based intermediary company, to pay bribes to decision-makers at Petróleo Brasileiro S.A. (Petrobras) in order to win a contract worth approximately $190 million to design a gas-to-chemicals complex in Brazil called Complexo Gás-Químico UFN-IV.

“Amec Foster Wheeler conspired to pay bribes to officials in Brazil as part of a corrupt scheme to obtain a $190 million government contract and generate millions of dollars in profits,” stated Jacquelyn M. Kasulis, Acting U.S. Attorney for the Eastern District of New York.

The company has also agreed to settle with the United Kingdom’s Serious Fraud Office and the Ministério Público Federal, the Advogado-Geral da União, and the Controladoria-Geral da União in Brazil.

A subsidiary of Wood, the parent company of Amec Foster Wheeler, has also agreed to resolve a related civil matter with the U.S. Securities and Exchange Commission (SEC).

“Today’s announcement demonstrates the FBI’s dedication to work with our international partners in the global effort to hold individuals and companies accountable who believe corruption is the only way to do business,” stated FBI Assistant Director-in-Charge Steven M. D’Antuono.

The company’s admissions and court documents outline a lengthy and complex scheme to evade anti-bribery laws and reap millions of dollars in profits from the contract.
