Two Brothers Sentenced for Crack Distribution and Conspiracy in Louisiana
Tonta J. Octave, 34, and his brother Kavis Octave, 31, both residents of Vacherie, Louisiana, were sentenced to prison time for their roles in a crack distribution conspiracy. U.S. District Court Judge Lance M. Africk handed down the sentences.
According to prosecutors, the Octave brothers were found guilty in four counts of a five-count third superseding indictment for conspiracy to possess and distribute cocaine base, also known as crack. A federal jury convicted them in November 2012 after a two-day trial.
Prosecutors presented evidence that Kavis and Tonta Octave sold between one and two ounces of crack to a Drug Enforcement Administration cooperating informant on three separate occasions in March and May 2012. The sales were captured on audio-video recordings.
At the time of Tonta Octave’s arrest, he was found attempting to flee his residence in a vehicle with $25,747 in cash. The money, which was kept in a freezer and was still ice cold, was forfeited to the government as drug proceeds at the conclusion of the trial.
Tonta Octave was sentenced to 120 months in the custody of the Bureau of Prisons, followed by a term of eight years supervised release. He was also ordered to pay a $200 special assessment fee. Kavis Octave received a 90-month prison sentence and four years of supervised release. He was ordered to pay a $400 special assessment fee.
The case was investigated by the Drug Enforcement Administration, St. James Parish Sheriff’s Office, and the Jefferson Parish Sheriff’s Office. Assistant U.S. Attorneys Sean Toomey and Andre Lagarde handled the prosecution.
The sentencing marks a significant blow to the Octave brothers’ operation, which was found to be involved in the distribution of crack cocaine in the Vacherie area. The convictions and sentences serve as a reminder of the consequences of engaging in such criminal activity.
