Davenport Man Found Guilty of Felon in Possession of Firearm

A Davenport man has been found guilty of felon in possession of a firearm after a three-day jury trial. Xavier Elfonsto Buckner, 27, was convicted on May 11, 2016, in federal court.

According to evidence presented at trial, Buckner knowingly possessed a .380 caliber Smith and Wesson Bodyguard handgun that was manufactured outside of the state of Iowa. The handgun was seized from Buckner after a vehicle, in which he was a passenger, fled from the Davenport Police Department.

Witness testimony revealed that the firearm seized from Buckner was connected to spent shell casings seized after an earlier shooting that occurred in the 700 block of W. 14th Street on August 3, 2015. An Iowa Division of Criminal Investigation Criminalist testified that based on ballistics testing, the firearm was the same one connected to the shooting.

This conviction marks the second time Buckner has been found guilty of a crime punishable by imprisonment for a term exceeding one year. Buckner was previously convicted in 2006.

The case was investigated by the Davenport Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives. The United States Attorney’s Office for the Southern District of Iowa prosecuted the case as part of the Project Safe Neighborhood initiative.

Xavier Buckner is scheduled to be sentenced at a later date. The maximum penalty for a felon in possession of a firearm is 10 years in prison and a $250,000 fine.
