A 29-year-old Penitas resident, Jesus David Gutierrez, has been sentenced to 110 months in federal prison for his role in receiving and distributing a staggering 56,000 files containing child sexual abuse material. The investigation, led by the FBI’s McAllen office, revealed that Gutierrez was not only downloading and sharing these heinous files but also involved in the sale of adult pornography and collecting child sex abuse material for future sales. The case against Gutierrez began to unfold on June 3, 2025, when law enforcement executed a search warrant at his residence, finding him hiding in his bedroom closet. Gutierrez admitted to having child sexual abuse material on his cellular phone, leading to a forensic analysis that uncovered 63 videos and 141 images depicting prepubescent children engaged in sexually explicit conduct.
Gutierrez pleaded guilty on October 2, 2025, and has been in custody since. U.S. District Judge Drew B. Tipton ordered Gutierrez to pay $6,000 in restitution and to serve five years of supervised release following his prison term, during which time he will be subject to strict requirements limiting his access to children and the internet. Furthermore, Gutierrez will be required to register as a sex offender.
The investigation was part of Project Safe Childhood, a nationwide initiative launched by the Department of Justice in May 2006 to combat the growing epidemic of child sexual exploitation and abuse. This case highlights the critical work of law enforcement agencies and the judicial system in protecting vulnerable populations and holding perpetrators accountable for their crimes.
