Marcus Elliott, a 40-year-old Amherst, NY, resident, has been sentenced to 78 months in prison for receiving and soliciting child pornography. In September 2020, Elliott began communicating with a 12-year-old girl on Snapchat, during which she sent him a sexually explicit photo. He also admitted to engaging in sexual activity with the minor and requesting that she produce child pornography on other occasions.
The investigation, led by the Federal Bureau of Investigation, West Seneca Police Department, and Amherst Police Department, recovered the explicit image from Elliott’s phone in June 2025, following a disclosure by the minor victim. Elliott’s actions led to a conviction for receipt of child pornography.
U.S. District Judge Lawrence J. Vilardo handed down the sentence, which includes 30 years of supervised release. The case was prosecuted by Assistant U.S. Attorney Aaron J. Mango.
The sentencing serves as a reminder of the severe consequences for those who engage in the exploitation and abuse of children. Law enforcement agencies continue to work tirelessly to identify and prosecute individuals who commit such heinous crimes.
