South Dakota Man Gets Prison Time for Burglary

In a recent case, Christian Kelly, a 20-year-old man from White River, South Dakota, was sentenced to 12 months and 1 day in custody for his involvement in a first degree burglary in May 2013.

According to court documents, Kelly and his co-defendant broke into the victim’s home in Lower Swift Bear, Mellette County, on May 10, 2013. Once inside, Kelly found the victim asleep in a bedroom and they began to argue. Kelly then punched and struck the victim several times before exiting the house.

Kelly was indicted by a federal grand jury on July 17, 2013, for First Degree Burglary and Assault with a Dangerous Weapon. He eventually pled guilty to First Degree Burglary on April 23, 2014.

U.S. District Judge Roberto A. Lange sentenced Kelly on July 14, 2014. In addition to the 12 months and 1 day of custody, Kelly was ordered to serve 2 years of supervised release and pay a $100 special assessment to the Federal Crime Victims Fund.

The case was investigated by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Marie H. Ruettgers prosecuted the case.

Kelly was remanded to the custody of the U.S. Marshals Service after the sentencing.

The incident highlights the importance of being cautious when dealing with strangers and the serious consequences of breaking and entering.
