Bangor, ME – Whiting man Daniel Fitzsimmons, 54, pleaded guilty to social security fraud in federal court, U.S. Attorney Thomas E. Delahanty II announced. According to court records, Fitzsimmons began receiving Social Security Disability Insurance (SSDI) payments in 2002.
The defendant received over $157,000 in SSDI benefits from 2002 to 2013, which are paid by the Social Security Administration (SSA) to people with disabilities. However, an investigation revealed that Fitzsimmons was actively engaged in commercial fishing during that period.
In order to obtain SSDI benefits, Fitzsimmons was required to certify that he could no longer perform substantial gainful work. He submitted numerous forms to the SSA and participated in an in-person interview, reporting little work activity and low annual earnings. The investigation found that these statements were false.
The defendant faces up to five years in prison and a $250,000 fine for his crimes. He will be sentenced after a presentence investigation report is completed by the U.S. Probation Office. The case was investigated by the SSA’s Office of Inspector General and the U.S. Coast Guard.
