Daniel Huzinec, Receipt of Child Pornography, New York 2017

Daniel Huzinec, 25, of Buffalo, NY, stood before U.S. District Court Judge Lawrence J. Vilardo and pleaded guilty to receipt of child pornography—a crime that carries a mandatory minimum of five years in federal prison, up to 20 years behind bars, and a $250,000 fine.

The case, prosecuted by Assistant U.S. Attorney Stephanie Lamarque, traces back to December 2014, when Huzinec shared graphic images of children engaged in sexually explicit conduct over a peer-to-peer network. The files included depictions of adults sexually abusing minors and children involved in sexual acts with other minors—material now confirmed as child pornography under federal law.

On January 27, 2015, Homeland Security Investigations agents raided Huzinec’s home on Marilla Street, seizing a laptop and other digital devices. At the time of the search, Huzinec, who served as an Assistant Scout Master, waived his Miranda rights and admitted to taking sexually explicit photos of a 16-year-old boy while chaperoning a Boy Scout camping trip—images captured on his cell phone as the teen slept.

Forensic analysis of Huzinec’s electronics revealed those disturbing photos, along with additional child pornography, including explicit images of a 15-year-old boy he had previously manipulated. In November 2014, Huzinec created a fake email account, posed as a teenage girl, and lured the former scout to send nude pictures—images later recovered from his computer.

As part of his plea agreement, Huzinec admitted not only to receiving child pornography but also to producing it—specifically the images of the 15- and 16-year-old victims. His role as a trusted scout leader magnifies the betrayal at the heart of the crime, turning a position of mentorship into one of predation.

Sentencing is set for April 27, 2017, at 12:30 p.m. before Judge Vilardo. The investigation was led by Immigration and Customs Enforcement, Homeland Security Investigations, under Acting Special Agent-in-Charge Kevin Kelly. Acting U.S. Attorney James P. Kennedy, Jr. announced the plea, underscoring the federal crackdown on those who exploit children, especially under the guise of community trust.
