Darrick D. Fleming, II, Unlawful Possession of Firearms, West Virginia 2015

A Cleveland man has landed in hot water after being found guilty of violating federal firearm laws in West Virginia.

Darrick D. Fleming, II, 28, was convicted of unlawful possession of a firearm today in federal court in Wheeling, West Virginia.

The charges stem from a June 2015 incident in Ohio County, West Virginia, where Fleming was discovered in unlawful possession of a 9mm pistol.

Fleming’s conviction is a direct result of his prior felony conviction in the Court of Common Pleas of Franklin County, Ohio for the offense of ‘Carrying a Concealed Weapon.’

As a convicted felon, Fleming is prohibited from possessing firearms, but he was found to be in possession of a 9mm pistol, leading to his current charges.

Fleming pleaded guilty to a criminal Information charging him with one count of ‘Prohibited Person in Possession of a Firearm.’

He now faces up to 10 years in prison and a fine of up to $250,000.

Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.

Assistant U.S. Attorney Stephen Vogrin prosecuted the case on behalf of the government, with the Wheeling, West Virginia Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives leading the investigation.

U.S. Magistrate Judge James E. Seibert presided over the case.
