A Delaware Department of Labor showdown with the feds ended with a court-ordered compliance with a federal subpoena. Homeland Security Investigations (HSI) issued the subpoena to the department last year as part of an ongoing immigration-related worksite enforcement investigation. But the department refused, sparking a federal lawsuit.
Chief Judge Colm F. Connolly ruled the HSI investigation had a legitimate purpose and the subpoena was valid. The Delaware Department of Labor must now hand over the documents demanded by the subpoena.
U.S. Attorney Benjamin L. Wallace said the state agency’s refusal to comply was ‘political’ and not based on legal reasons. He added that federal law applies to everyone, and the court recognized this.
Special Agent in Charge Eric McLoughlin said the court’s decision affirms the legitimacy of HSI’s worksite enforcement investigations.
