Denise Penke, Transferring Firearm to a Felon, Nebraska 2025

Denise Penke, a 52-year-old Omaha woman, has been sentenced to five days in prison for transferring a firearm to a felon. On February 7, 2025, Chief United States District Judge Robert F. Rossiter, Jr. handed down the sentence in federal court in Omaha.

According to court records, Penke admitted to selling a Glock 43 9mm pistol to an individual who was a convicted felon. The transaction took place on January 4, 2023, at a residence in Omaha. The buyer, who was cooperating with law enforcement, purchased the firearm from Penke and captured the transaction on audio and video recordings.

During the plea hearing, Penke admitted that she knew the buyer was a convicted felon. The recordings show Penke holding the handgun wrapped in a yellow rag as she sold it to the buyer.

The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives. Penke will also begin a three-year term of supervised release immediately after serving her five-day sentence.
