Assault and Child Abuse Charges Hit Rosebud Man
A Rosebud man has been hit with a string of charges, including assault with a dangerous weapon, assault resulting in serious bodily injury, and child abuse.
Dustin Witt, 25, was indicted by a federal grand jury on March 15, 2017. He appeared before U.S. Magistrate Judge Mark A. Moreno on April 10, 2017, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on June 6, 2016, Witt assaulted an individual with shod feet with intent to do bodily harm and that the assault resulted in serious bodily injury. The Indictment further alleges that Witt abused, exposed, tortured, tormented, and cruelly punished a child who had not attained the age of eighteen.
The charges are merely an accusation and Witt is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Kirk Albertson is prosecuting the case.
Witt was released on bond pending trial. A trial date has not been set. The case will continue to unfold in the coming weeks and months, with all parties waiting with bated breath to see what the outcome will be.
