Albuquerque Man Sentenced to 70 Months for Raping Unconscious Woman
A 34-year-old Ohkay Owingeh man has been sentenced to 70 months in prison for raping an unconscious woman at a family friend’s apartment after a night of drinking in July 2022.
According to court documents, Dwayne Calvert, an enrolled member of the Pueblo of Ohkay Owingeh, raped Jane Doe while she lay unconscious on a couch after a night of heavy drinking. The sexual assault occurred at the apartment of a family friend where Calvert had been babysitting.
The family friend and her boyfriend witnessed Calvert naked on top of the unconscious Jane Doe and alerted authorities. Jane Doe had no memory of the rape.
In his plea agreement, Calvert admitted he knew Jane Doe was passed out from consuming too much alcohol and never consented to a sexual act.
After completing his term of imprisonment, Calvert will be required to serve five years of supervised release. ‘There is no parole in the federal system,’ officials noted.
The case was investigated by the Bureau of Indian Affairs Office of Justice Services. Assistant United States Attorney Zachary Jones is prosecuting the case.
U.S. Attorney Alexander M.M. Uballez made the announcement today.
Calvert’s sentence is a harsh reminder of the severe consequences of committing such heinous crimes. The victim’s trust was brutally broken, and she will never be the same.
