New Orleans, Louisiana – In a shocking turn of events, EMNER ISAIAS NAJERA-NAJERA, a 41-year-old native of Guatemala, has been indicted for illegal re-entry of a removed alien, in violation of Title 8, United States Code, Section 1326(a), announced U.S. Attorney David I. Courcelle.
According to the charging document, Najera-Najera was found in the United States on March 12, 2026, having reentered the country without authorization from the Attorney General of the United States after being previously deported on June 22, 2017.
Najera-Najera faces up to two years imprisonment, a fine of up to $250,000, up to one year of supervised release, and a mandatory special assessment fee of $100.00 for re-entry of a removed alien.
U.S. Attorney Courcelle reiterated that an indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.
This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.
Operation Take Back America streamlines efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).
Najera-Najera’s case is a stark reminder of the consequences of re-entering the United States without proper authorization. The U.S. Border Patrol deserves credit for their work in investigating this matter, and we will continue to work tirelessly to protect our communities from those who would seek to exploit our borders.
Najera-Najera is scheduled to appear in court at a later date to face the charges against him.
