Felon Displays Loaded Gun During Altercation, Gets 54 Months
MADISON, WIS. – A Menomonie man is headed to prison after displaying a loaded firearm during an altercation in downtown Eau Claire. Xavier Gentry, 33, was sentenced to 54 months in prison for unlawfully possessing a loaded firearm as a convicted felon.
Gentry pleaded guilty to the charge on May 21, 2021. On June 7, 2020, he pulled out a loaded firearm and displayed it during an altercation outside a bar in downtown Eau Claire. Responding officers arrested him in a nearby parking lot after he ran from the scene.
This is not Gentry’s first run-in with the law. He was sentenced to state probation in Eau Claire County Case No. 19CF1767 just seven days before the altercation. That case charged Gentry for various crimes after he shot and injured a person and injured a dog during a drug robbery.
Gentry is currently serving a three-and-a-half-year prison sentence in connection to Eau Claire County Case No. 20CF774, where he was convicted of possessing cocaine with intent to distribute on the same night as the federal offense.
U.S. District Judge William M. Conley sentenced Gentry, noting that the defendant’s extensive criminal history, which includes 13 prior convictions and crimes of violence, shows that he has been unable or unwilling to take responsibility for his actions.
The case was brought as part of Project Safe Neighborhoods (PSN), the U.S. Justice Department’s program to reduce violent crime. The PSN approach involves collaboration by federal, state, and local law enforcement agencies, prosecutors, and communities to prevent and deter gun violence.
Assistant U.S. Attorney Taylor L. Kraus handled the prosecution of the case, with assistance from the Eau Claire Police Department, Bureau of Alcohol, Tobacco, Firearms and Explosives, and Eau Claire Sheriff’s Department.
