Felon Sentenced to 40 Months in Prison for Gun Possession
Aubrey Gardner, a 28-year-old from Huntington, West Virginia, has been sentenced to 40 months in prison for being a felon in possession of a firearm. Gardner’s conviction stems from a February 2021 incident where he was found with a gun in his waistband during a traffic stop.
According to court documents, Gardner was a passenger in a vehicle that was pulled over by officers with the Huntington Police Department in the 2800 block of 8th Avenue. The officers discovered a firearm in Gardner’s waistband, which led to his arrest. Gardner’s possession of the firearm is prohibited due to a 2018 conviction for possession with intent to distribute heroin.
Gardner’s sentence was imposed by United States District Judge Robert C. Chambers. Assistant United States Attorney Stephanie S. Taylor prosecuted the case on behalf of the Government.
The case is part of Project Safe Neighborhoods (PSN), a program aimed at reducing violent crime. PSN brings together a broad spectrum of stakeholders to identify and address the most pressing violent crime problems in the community.
Aubrey Gardner’s sentence serves as a reminder of the consequences of violating federal firearms laws. As a convicted felon, Gardner was prohibited from possessing a firearm, and his actions have resulted in a significant prison sentence.
