Fentanyl Kingpin Sentenced to 70 Months in Jail
A California man has been sentenced to 70 months in jail for his role in a massive fentanyl trafficking operation in Erie, Pennsylvania.
Victor Daniel Gutierrez, 48, was convicted of violating federal drug laws and was sentenced by United States District Judge Susan Paradise Baxter.
According to court documents, Gutierrez conspired to possess with intent to distribute and distribute forty grams or more of a mixture and substance containing a detectable amount of fentanyl between May 28, 2020, and June 8, 2020. The charge was based on an intercepted United States Mail parcel that Gutierrez shipped to Pennsylvania from California containing approximately 340 grams of fentanyl pills.
In addition to the fentanyl charges, Gutierrez also admitted to attempting to possess with intent to distribute 2.125 kilograms of cocaine and 1.535 kilograms of heroin in and around September of 2019.
Prosecutors argued that Gutierrez’s actions had a devastating impact on the community, furthering addiction and heartbreak for those suffering from drug use and addiction in the Western District of Pennsylvania.
Gutierrez’s sentence was handed down despite his claims of mitigating circumstances. Assistant United States Attorney Paul S. Sellers prosecuted the case on behalf of the government.
Acting United States Attorney Stephen R. Kaufman commended the United States Postal Inspection Service for the investigation leading to the successful prosecution of Gutierrez.
Gutierrez will serve his sentence in federal prison, bringing an end to a case that highlighted the dangers of fentanyl trafficking in the region.
The case was a significant victory for law enforcement and a reminder of the harsh consequences faced by those who engage in such crimes.
