Fentanyl Overdose Death: Montebello Man Charged
A 28-year-old Montebello resident has been charged with causing a fatal fentanyl overdose in a disturbing case that has sent shockwaves through the community.
Edwin Oliva, 28, was named in a superseding indictment with distribution of fentanyl resulting in death, a charge that carries a mandatory minimum sentence of 20 years in federal prison and a statutory maximum sentence of life imprisonment.
The victim, who was an acquaintance of Oliva’s, arrived at his residence in the early hours of February 28, where Oliva allegedly gave her a fatal dose of fentanyl. According to court documents, Oliva admitted to law enforcement that fentanyl was the drug he gave the victim.
A pathologist employed by the Los Angeles County Medical Examiner-Coroner concluded that the victim died as a result of the effects of fentanyl and alcohol.
The charges against Oliva also include possession with intent to distribute more than four pounds of heroin, possession with intent to distribute fentanyl, and carrying a firearm during and in relation to a drug trafficking crime.
Oliva has been in federal custody since his arrest in March and will be arraigned early next month on the superseding indictment. United States District Judge André Birotte Jr. previously scheduled a trial date of November 5 for this case.
The investigation into the fentanyl overdose death was conducted by the Drug Enforcement Administration and the Montebello Police Department, with Assistant United States Attorney Gabe Podesta handling the prosecution.
