Demetrius McIlwain, 52, of Williston, South Carolina, was involved in a domestic violence incident that led to his arrest and subsequent sentencing to 11 years in federal prison for illegally possessing firearms. The incident occurred when deputies from the Kershaw County Sheriff’s Office responded to a location in search of a suspect. McIlwain, who was found in a running vehicle with a woman in the passenger seat, refused to cooperate with the deputies and attempted to flee the scene.
During the investigation, deputies found an AR-style pistol, a shotgun, and a third firearm in the vehicle, as well as a small amount of fentanyl. McIlwain, who was prohibited from possessing firearms and ammunition due to prior convictions, admitted to being the driver of the vehicle. His prior convictions include grand larceny, burglary, criminal sexual conduct, malicious injury to personal property, and assault and battery with intent to kill.
McIlwain’s sentence of 135 months in federal prison, to be followed by a three-year term of court-ordered supervision, was handed down by United States District Judge Mary Geiger Lewis. The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Kershaw County Sheriff’s Office, and prosecuted by Assistant U.S. Attorney William K. Witherspoon.
The sentence reflects the seriousness of McIlwain’s crimes and the need to protect the community from individuals who pose a threat to public safety.
