COUNCIL BLUFFS, IA – Her Tou Yang, 42, of Detroit, Michigan, is headed to federal prison after admitting to running drugs and illegally peddling firearms in Council Bluffs, Iowa. Yang was sentenced to 60 months and 1 day behind bars on February 15, 2023, following a guilty plea to possession with intent to distribute marijuana and possession of a firearm in furtherance of a drug trafficking crime.
The ATF, along with the Council Bluffs Police Department, uncovered a scheme where Yang was moving both product and weaponry. On August 15, 2021, Yang was caught with approximately five pounds of marijuana and a stolen firearm, which he then sold to an individual in Council Bluffs. Less than a month later, on September 9, 2021, he upped the ante, selling an AR-style rifle in the same city.
Federal prosecutors didn’t mince words, highlighting the seriousness of the crimes. The sentencing isn’t just about the drugs, it’s about the reckless disregard for public safety displayed by Yang’s actions – trafficking narcotics while simultaneously arming potentially dangerous individuals with illegally obtained weapons. After his release, Yang will face an additional two years of supervised release.
U.S. Attorney Richard D. Westphal of the Southern District of Iowa announced the sentencing, framing it as a win for Project Safe Neighborhoods (PSN). PSN is a federal initiative aimed at bringing together law enforcement at all levels and the communities they serve to tackle violent crime and gun violence. The DOJ launched a renewed focus on PSN in May 2021, emphasizing community trust, prevention, and targeted enforcement.
While authorities tout PSN as a solution, the case underscores the continued flow of illegal drugs and firearms across state lines. The stolen firearm in Yang’s possession raises questions about its original source and the broader network involved in its theft and subsequent sale. The ATF’s Kansas City Field Division led the investigation, but the issue remains: how many other Yangs are operating in the shadows, profiting from misery and putting communities at risk?
